The “adjustment of status” (AOS) process allows foreign nationals who entered the U.S. legally, usually with a temporary visa, to apply for permanent residence to stay in the U.S. Some foreign nationals may qualify to adjust status through certain family relationships. Upon successful completion of this process, the family member will obtain a “green card” as proof of their permanent residence in the U.S.
The AOS process takes place entirely within the U.S. Because the AOS process is essentially a combined family petition and permanent residence application process, there are numerous requirements that must be met at the outset to ensure a successful application. Among these requirements, U.S. citizen petitioners must demonstrate they meet certain financial qualifications, and applicants must show there is nothing in their personal or immigration history that disqualifies them from receiving benefits.
Adjustment of status processes require several forms, including separate applications for temporary employment authorization and travel permission to leave the U.S. during the process if necessary. Improperly completed forms or missing supporting documents can result not only in a denial, but permanent damage to a person’s U.S. immigration record. Given the complexity of this application, legal assistance is strongly recommended.
